1. Acceptance of Terms

These TifoXR Website Terms of Use ("Terms") govern access to and use of the public TifoXR website operated by Global Mobile Software LLC ("GMS," "we," "us," or "our"). 

By accessing or using the TifoXR website, you agree to these Terms. If you do not agree to these Terms, do not use the website. 

These Terms apply to the public TifoXR website only. Access to or use of TifoXR Immersive, TifoXR 3D Streaming, TifoXR CMS, paid experiences, club-specific deployments, or registered-user environments may be governed by separate Product Terms, End User License Agreements, club-specific terms, acceptable-use requirements, privacy notices, or other applicable product-specific policies. 

2. TifoXR Information

The TifoXR website may describe products, features, fan experiences, streaming functionality, CMS tools, analytics, club partnerships, integrations, or future functionality. 

Unless expressly stated in a written agreement signed by GMS, website descriptions are provided for informational purposes only and do not create binding service-level commitments, warranties, representations, or obligations to provide any particular feature or functionality. 

Information regarding specific TifoXR deployments, including user-generated content, content moderation, abuse reporting, advertising, recommender systems, and applicable Digital Services Act requirements, is governed by the applicable TifoXR policies and notices. 

3. Intellectual Property

TifoXR, the TifoXR platform, website content, product names, marks, interfaces, designs, workflows, software, analytics, and related materials are owned by GMS or its licensors and are protected by applicable intellectual-property laws. 

Club names, marks, photographs, footage, player images, league materials, sponsor assets, and other third-party materials may be owned by the applicable club, league, player, sponsor, or other rights holder. 

No ownership rights or licenses are granted through these Terms except as expressly stated by GMS or the applicable rights holder.

4. Acceptable Use

You may not use the TifoXR website to:

  • violate applicable law or regulation; 

  • interfere with the operation, availability, or security of the website; 

  • attempt to gain unauthorized access to systems, accounts, databases, or networks; 

  • scrape, harvest, copy, or systematically extract website data or content except as permitted by applicable law; 

  • infringe intellectual-property, privacy, publicity, or other rights; 

  • impersonate another person or entity; 

  • misrepresent an affiliation with a club, league, sponsor, GMS, or TifoXR; or 

  • upload, transmit, introduce, or distribute malware, harmful code, or other malicious material. 

Additional acceptable-use and content-moderation requirements may apply when using TifoXR product environments or submitting or interacting with user-generated content. 

5. Third-Party and Club Content

The website may reference or display information concerning clubs, leagues, sponsors, venues, content, integrations, or third-party services. 

Unless expressly stated, GMS does not own or control third-party or club content and does not guarantee its accuracy, availability, legality, completeness, or continued display. 

Third-party services and websites may be subject to their own terms, privacy notices, and policies. 

6. No Professional Advice

Website content is provided for general informational purposes and is not legal, tax, financial, medical, health, safety, or other professional advice. 

You should not rely on website content as a substitute for advice from a qualified professional. 

7. Disclaimers and Limitation of Liability

The website is provided "as is" and "as available." 

To the maximum extent permitted by applicable law, GMS disclaims all warranties, express or implied, relating to the website and its content, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, title, and non-infringement. 

To the maximum extent permitted by applicable law, GMS and its officers, members, managers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or lost-profit damages arising out of or relating to your use of, or inability to use, the website. 

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

Our collection and use of information through the public TifoXR website is described in the applicable TifoXR Website Privacy Policy and Cookie Policy. 

The website may use cookies and similar technologies as described in the applicable Cookie Policy. 

We do not knowingly sell personal information collected through the website. Where applicable law provides additional rights or choices regarding personal information, those rights and choices are described in the applicable privacy notice. 

Information collected through the public TifoXR website is generally retained for up to seven years, unless a longer or shorter retention period is required or permitted by applicable law, or a different retention period is specified in the applicable privacy notice. 

Privacy practices applicable to TifoXR product environments, registered-user accounts, TifoXR CMS, or club-specific deployments may differ and are governed by the applicable product-specific privacy notice or policy. 

9. Governing Law

These Terms are governed by the laws of the State of New York, subject to any mandatory consumer-protection or other applicable laws that may apply in your country or place of residence.
